Fifth Amendment

Nobody will be obliged to answer for a crime punishable by capital punishment or with another infamous one if a grand jury does not denounce or indict him, with the exception of cases that are presented in the sea or land forces or in the national militia when it is found. in effective service in time of war or public danger; nor will any person be put twice in danger of losing life or any limb for the same crime; nor will she be compelled to testify against herself in any criminal trial; or be deprived of life, liberty, or property without due process of law; nor will private property be occupied for public use without fair compensation.

 

Rights Contained in Fifth Amendment:

  • Right not to be tried twice for the same crime

  • Right to remain silent

  • Right to a fair legal process
